Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you (“you,” “your,” or “Player”) and [Company Legal Name], a company organized under the laws of [State of Formation] with its principal place of business at [Registered Business Address], doing business as “Gautam Gaming” (“Gautam Gaming,” “we,” “us,” or “our”). By accessing the Service, creating an account, starting a chat, or submitting a deposit, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Responsible Play Policy, our Refund Policy, our Sweepstakes Official Rules, and our AML & Identity Verification Policy, each of which is incorporated by reference. If you do not agree, do not use the Service.

1. Definitions

• “Game Platform” means a third-party sweepstakes or social-gaming application (for example, Juwa, Orion Stars, Fire Kirin, Game Vault, Ultra Panda, or Vegas Sweeps) that we are not affiliated with, do not own, and do not operate.
• “Deposit” means funds you send us to obtain entries, credits, or a balance on a Game Platform.
• “Load” means the action of applying credits or a balance to your account on a Game Platform on your behalf.
• “Redemption” or “Payout” means a request to convert eligible winnings into a cash-equivalent disbursement, subject to verification and these Terms.
• “Entry” means a sweepstakes entry obtained either with a Deposit or through the free Alternative Method of Entry described in the Sweepstakes Official Rules.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and a legal resident of a jurisdiction in which sweepstakes gaming is lawful. By using the Service, you represent and warrant that:

• you meet the age and residency requirements above;
• you are not located in, or a resident of, any state, territory, or country where the Service is prohibited or where participation would be unlawful (the Service is void where prohibited);
• you are not on any government sanctions, denied-persons, or politically-exposed-persons list, and you are not accessing the Service from an embargoed jurisdiction;
• you are not a person whose participation is restricted under our Sweepstakes Official Rules (for example, employees, contractors, or members of their immediate household).

We may refuse, suspend, or terminate access at any time if we believe you do not meet, or no longer meet, these requirements. It is your responsibility to know and comply with the laws that apply to you.

3. Nature of the Service — what we are and are not

Gautam Gaming is an agent and concierge service. We help you fund your play, load balances onto Game Platforms, and request payouts of eligible winnings through live chat and supported payment methods. We are a promotional sweepstakes service and a facilitator only. We do not operate the games, do not control or influence their outcomes, odds, availability, rules, or software, and are not a casino, a bank, a money-services business operating outside applicable law, or a licensed gambling operator. Game outcomes are determined solely by the third-party Game Platforms.

Sweepstakes are promotions of chance. No purchase is necessary to enter or win. A Deposit does not increase your chances of winning. A free Alternative Method of Entry is always available as described in the Sweepstakes Official Rules.

4. Accounts, identity, and security

You may interact with us through live chat and, where offered, a customer account. You agree to provide accurate, current, and complete information, to keep it updated, and to maintain the confidentiality of any credentials. You are responsible for all activity conducted through your account or chat session. Notify us immediately of any unauthorized use. We may decline to create, or may close, any account at our discretion, including duplicate accounts or accounts opened with false information.

5. Identity verification & anti-money-laundering

To protect against fraud, underage play, and financial crime, and to comply with applicable law, we may require you to verify your identity, age, source of funds, and payment ownership before processing Deposits, Loads, or Payouts. We may pause, hold, or decline any transaction pending verification. Your use of the Service is subject to our AML & Identity Verification Policy.

6. Deposits, loads, and payouts

• Deposits are processed only through the payment methods we offer in chat. By submitting a Deposit you authorize the charge and confirm you are the lawful owner of the payment instrument.
• Loads are applied to the Game Platform account you designate, usually within minutes during operating hours. We are not responsible for delays caused by the Game Platform, your network, or your payment provider.
• Minimums & limits. We may set and change minimum and maximum amounts, daily/weekly limits, and per-method limits, and may apply additional limits for risk, responsible-play, or compliance reasons.
• Payouts are reviewed for eligibility, fraud, and compliance. Approved Payouts are sent through an agreed method. Processing times are estimates, not guarantees, and may be extended for verification.
• Errors. If a Deposit, Load, or Payout is processed in error (for example, a wrong amount or a duplicate), you agree to cooperate in correcting it, including returning funds that were not owed to you.
• Taxes. You are solely responsible for any taxes on winnings or disbursements, and for any reporting required by law. We may issue tax forms and withhold amounts where required.

7. Promotions and sweepstakes

Bonuses, match offers, and promotions are optional, may be changed or withdrawn at any time, and are governed by their specific terms and by our Sweepstakes Official Rules. We may void entries, bonuses, or winnings obtained through fraud, error, abuse, automation, or violation of these Terms.

8. Acceptable use

You agree that you will not, and will not attempt to:

• use the Service for any unlawful, fraudulent, or deceptive purpose, including money laundering or financing illegal activity;
• use another person’s identity or payment instrument, or open accounts on behalf of others;
• collude, exploit bugs, use bots, scripts, or automation, or otherwise manipulate games, balances, or Payouts;
• initiate fraudulent chargebacks or payment disputes (see our Refund Policy);
• abuse, harass, threaten, or defraud our staff, agents, or other players;
• access the Service from a prohibited jurisdiction or circumvent geographic or eligibility restrictions (including via VPN or proxy);
• interfere with, probe, or attempt to gain unauthorized access to the Service or its systems.

We may investigate suspected violations and cooperate with law enforcement.

9. Third-party Game Platforms and links

The Game Platforms and any third-party websites, payment processors, or services are operated by independent parties under their own terms and privacy practices. We do not endorse, control, or assume responsibility for them, their content, their software, or their outcomes. Your use of a Game Platform is at your own risk and subject to that platform’s rules. Any dispute about game outcomes must be resolved with the relevant Game Platform.

10. Intellectual property

The Service, including our name, logo, text, graphics, and design, is owned by us or our licensors and protected by intellectual-property laws. Game names and artwork are the property of their respective owners and are used for identification only; their appearance does not imply affiliation or endorsement. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended personal, non-commercial purpose. All other rights are reserved.

11. No guarantee of winnings; assumption of risk

Sweepstakes gaming involves chance, and outcomes are uncertain. We make no representation or warranty that you will win, recover Deposits, or achieve any result. You play for entertainment and at your own risk, and you should only commit funds you can afford to set aside for entertainment. Please review our Responsible Play Policy.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY GAME PLATFORM WILL BE AVAILABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GAUTAM GAMING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST WINNINGS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THE ACTS OF ANY GAME PLATFORM OR PAYMENT PROVIDER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO US IN THE NINETY (90) DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless Gautam Gaming and its affiliates and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or third-party right, or your interactions with any Game Platform.

15. Suspension and termination

We may suspend or terminate your access to the Service, withhold or reverse transactions, or void entries, bonuses, or winnings, at any time and without prior notice, if we reasonably believe you have violated these Terms or applicable law, created a security, fraud, or compliance risk, or for any other lawful reason. Provisions that by their nature should survive termination will survive, including Sections 10–19.

16. Dispute resolution — arbitration and class-action waiver

Please read this Section carefully — it affects your legal rights. Except for claims that may be brought in small-claims court and claims for injunctive relief to protect intellectual property, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court, except where prohibited by law. You and we waive the right to a trial by jury and the right to participate in a class, collective, or representative action. The arbitration will take place in [County, State], or be conducted remotely, and these Terms are governed by the Federal Arbitration Act and the laws of [Governing-Law State], without regard to conflict-of-laws rules. You may opt out of arbitration by sending written notice to support@gautamgaming.com within 30 days of first accepting these Terms. 17. Governing law and venue

• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent; we may assign them freely.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Notices. We may give notice via the Service, chat, email, or by posting on the website.
